Advance Draft Update of

"Engineering and Design Manual - Coal Refuse Disposal Facilities"

Design Manual" Comment Period Extended Until April 30, 2008
    The National Mining Association has requested that MSHA extend the timeframe for the submittal of comments on the advance draft of the updated "Engineering and Design Manual: Coal Refuse Disposal Facilities" (Design Manual). MSHA wants all interested parties to have the opportunity to provide comments. Therefore, MSHA is extending the comment period as requested.

  • The new deadline for the submission of comments is April 30, 2008.


Following the failure in 1972 of a coal waste dam in Buffalo Creek, WV, which caused the deaths of 125 people, the Mining Enforcement and Safety Administration (MESA - the predecessor agency to MSHA) published the "Engineering and Design Manual: Coal Refuse Disposal Facilities" (Design Manual). This manual was intended to "serve as a uniform guide to safe refuse disposal practices for those concerned with this necessary function of coal mining and preparation."

MSHA is now having the Design Manual updated to reflect what has been learned about dam safety and coal-waste disposal in the more than thirty years since the original manual was published. The manual is being updated under a contract by D'Appolonia Engineering Division of Ground Technology, Inc. The purpose of the new manual is to provide updated technical information to the industry on the design, construction and maintenance of safe dams at coal mining operations.

An advance, draft copy of the updated manual is being posted on MSHA's web site to provide interested parties with the opportunity to review it and provide MSHA with comments. The advance draft can be accessed and downloaded by individual chapters through the links shown below. The final form of the updated Design Manual will be released in 2008 and made available to the industry.
