McATEER JOINS BENEFITS REVIEW BOARD
Davitt McAteer, assistant secretary of labor for mine safety and health since 1994, has accepted a position as a member of the U.S. Department of Labor's Benefits Review Board. The board considers and decides appeals of decisions by administrative law judges under the Black Lung Benefits Act and the Longshore and Harbor Workers' Compensation Act. McAteer's appointment took effect December 31, 2000. The Mine Safety and Health Administration's deputy assistant secretary, Robert A. Elam, will serve as acting assistant secretary.
During the nearly seven years that he directed the Mine Safety and Health Administration, McAteer was responsible for administration of the Federal Mine Safety and Health Act of 1977, a law intended to reduce mining accidents and health hazards. In 1996 and 1997, McAteer also served as acting Solicitor for the Department of Labor. Before his appointment to lead MSHA, McAteer was executive director of the Occupational Safety and Health Law Center. A West Virginia native, McAteer is a graduate of West Virginia College of Law and Wheeling Jesuit College.
