On November 10, 1997, Getchell Gold Corporation (Getchell), filed a petition pursuant to 101(c) of the Federal Mine Safety and Health Act of 1977 (Mine Act), 30 U.S.C. Sec. 811(c), and 30 CFR 44 et seq., for modification of the application of mandatory safety standard 30 CFR § 57.14130, at its Getchell Mine. Getchell requested that roll-over protective structures (ROPS) not be applicable for the John Deere Model 570B Grader S.N. DW570BX5544565 and the Caterpillar D3C Dozer S.N. 6SL0153.
On August 27, 1999, a request was filed with the Director of Standards, Regulations, and Variances by the petitioner for a withdrawal of the petition.
Therefore, pursuant to the authority delegated by the Secretary of Labor to the Administrator for Metal and Nonmetal Mine Safety and Health, Petition No. M-97-14-M for Modification of 30 CFR § 57.14130, at its Getchell Mine is DISMISSED without prejudice.
