SMITH: Good morning. My name is Becky Smith. I am the deputy director of the Mine Safety and Health Administrations Office of Standards, Regulations and Variances. This hearing was announced in a Federal Register document on July the 16th, and the announced purpose of this hearing was to obtain information from the public on a proposed rule that was published also on July 16th. That proposed rule would include shaft and slope construction workers under MSHA's Part 48 training requirements. Under the proposed rule, shaft and slope construction workers at surface and underground coal and metal and nonmetal mines will be treated like extraction and production workers and subject to the same Part 48 training requirements. We have not had individuals sign up to speak at this hearing, nor do we have individuals in attendance at this public hearing, therefore we are going to close the record at this point. We will come back on the record in about an hour and a half, about 10:30, to see if we do have speakers or attendees at that point, and we will reopen the record. (Off the record, 9:03.) MS.
