SUBJECT:      Filing Hazard Condition Complaints in the Uniform Mine File

Scope
This Procedure Instruction Letter (PIL) applies to all Coal Mine Safety and Health Personnel assigned the responsibility for maintaining the Uniform Mine File (UMF).

Purpose
This PIL establishes the procedures necessary in filing Hazard Complaints in the Uniform Mine File.

Procedure Instruction
Upon completion of all hazard condition complaint investigations, the sanitized version (version where all personal identifiable information has been removed), shall be filed under the title “Miscellaneous” under subtitle “Hazard Complaints” in the appropriate mine file. All complaints received, with either a positive or negative finding, shall be filed in the UMF. The complaints are to be removed quarterly so that only one year of history is retained.

Background
The primary purpose of the UMF is to provide enforcement personnel with current information for each underground and surface mine, contained in one file. MSHA personnel review the information in the UMF to plan inspections. Including hazard condition complaints in the UMF will enable MSHA to address particular issues, developing trends or problem areas that may be overlooked without this information.

Authority
The Federal Mine Safety and Health Act of 1977, as amended, 30 U.S.C. § 801 et seq.; 30 C.F.R. Part 43.

This instruction letter should be filed behind the tab marked “Procedure Instruction Letters” in the binder for Program Policy Handbooks and Procedure Instruction Letters.
