PROPOSED ORDER OF DISMISSAL

On August 2, 1999, Hutchinson Salt Company (Hutchinson), filed a petition pursuant to Section 101(c) of the Federal Mine Safety and Health Act of 1977 (Mine Act), 30 U.S.C. Sec. 811(c), and 30 CFR Part 44, for the modification of the application of mandatory safety standard 30 CFR § 49.5, at its Hutchinson Salt Company Mine. Hutchinson is a member of the Kansas City Mine Rescue Association (Association). In its petition, Hutchinson requested that it be permitted to store the mine rescue equipment for the Association at each mine rather than at a centralized location, as required by the standard.

On February 9, 2000, a request was filed by the petitioner to withdraw the petition. Therefore, pursuant to the authority delegated by the Secretary of Labor to the Administrator for Metal and Nonmetal Mine Safety and Health, Hutchinson Salt Company's Petition No. M-1999-012-M for Modification of 30 CFR § 49.5, at its Hutchinson Salt Company Mine is DISMISSED without prejudice.
