PROPOSED ORDER OF DISMISSAL

On August 5, 1999, G-P Gypsum Corporation (Gypsum), filed a petition pursuant to Section 101(c) of the Federal Mine Safety and Health Act of 1977 (Mine Act), 30 U.S.C. Sec. 811(c), and 30 CFR Part 44, for the modification of the application of mandatory safety standard 30 CFR § 49.5, at its Blue Rapids Mine & Mill. Gypsum is a member of the Kansas City Mine Rescue Association (Association). In its petition, Gypsum requested that it be permitted to store the mine rescue equipment for the Association at each mine rather than at a centralized location, as required by the standard.

On February 10, 2000, a request was filed by the petitioner to withdraw the petition. Therefore, pursuant to the authority delegated by the Secretary of Labor to the Administrator for Metal and Nonmetal Mine Safety and Health, G-P Gypsum Corporation's Petition No. M-1999-014-M for Modification of 30 CFR § 49.5, at its Blue Rapids Mine & Mill is DISMISSED without prejudice.
