PROPOSED ORDER OF DISMISSAL
On October 21, 2002, Lafarge Corporation (Lafarge) pursuant to Section 101(c) of the Federal Mine Safety and Health Act of 1977, 30 U.S.C. § 811(c) and 30 CFR 44 et seq., filed a petition for modification of 30 CFR § 57.12016 (Work on electrically-powered equipment).
30 CFR § 57.12016, Work on electrically-powered equipment, provides:
Electrically powered equipment shall be deenergized before mechanical work is done on such equipment. Power switches shall be locked out or other measures taken which shall prevent the equipment from being energized without the knowledge of the individuals working on it. Suitable warning notices shall be posted at the power switch and signed by the individuals who are to do the work. Such locks or preventive devices shall be removed only by the persons who installed them or by authorized personnel.
MSHA's investigation determined that Lafarge uses as warning signs specially designated and engraved locks which are easily identified by color and owner. The locks prevent the circuit from being energized without the knowledge of the individuals working on it. These specially designed locks may only be removed by the person who installed them or by authorized personnel. Because this method satisfies the requirements of the standard, the petition for modification is not necessary and is hereby:
DISMISSED.
