PROPOSED ORDER OF DISMISSAL

On July 26, 2004, Mississippi Lime Company pursuant to Section 101(c) of the Federal Mine Safety and Health Act of 1977, 30 U.S.C. § 811(c), and 30 CFR 44 et seq., filed a petition for modification of 30 CFR § 56.15005 (Safety belts and lines).

30 CFR § 56.15005 safety belts and lines provides:

Safety belts and lines shall be worn when persons work where there is danger of falling; a second person shall tend the lifeline when bins, tanks, or other dangerous areas are entered.

On May 1, 2007, a mine official for Mississippi Lime Company requested that the petition be canceled. Therefore, the petition for modification is not necessary and is hereby:

DISMISSED.
