PROPOSED ORDER OF DISMISSAL

On September 29, 2017, Klondex Gold and Silver Mining Co. filed a petition pursuant to Section 101(c) of the Federal Mine Safety and Health Act of 1977, 30 U.S.C. § 811(c) and 30 C.F.R. pt. 44. The petitioner sought a modification of the applications of mandatory safety standard 30 C.F.R. § 57.18025 at the Fire Creek Mine, 1.0. No. 26- 02691, located in Lander County, Nevada where it produces gold.

On March 14, 2019, MSHA received Klondex's request to withdraw the above referenced petition for modification. Therefore, the petition is not needed and should be dismissed.

Therefore, pursuant to the authority delegated by the Secretary of Labor to the Administrator for Mine Safety and Health Enforcement, Klondex Gold and Silver Mining Co.'s Petition for Modification of 30 C.F.R. § 57.18025 at its Fire Creek Mine, is hereby:

DISMISSED.

party to this action desiring a hearing on this matter must file in accordance with 30

C.F.R. § 44.14, within 30 days. The request for hearing must be filed with the Administrator for Mine Safety and Health Enforcement, 201 12th Street South, Suite 401, Arlington, Virginia 22202.
