Petition - Docket No. M-2007-030-C

February 27, 2008

In the matter of: Petition for Modification Chestnut Coal Company

No. 12 Slope

I.D. No. 36-09493 Docket No. M-2007-030-C PROPOSED ORDER OF DISMISSAL

On May 10, 2007, Chestnut Coal Company filed a petition pursuant to 101(c) of the Federal Mine Safety and Health Act of 1977 (Mine Act), 30 U.S.C. § 811(c), and 30 C.F.R. § 44 et seq., for the modification of the application of 30 C.F.R. § 75.360, a mandatory safety standard.

The petitioner requests modification of 30 C.F.R. § 75.360, as it applies to underground anthracite mines, to allow the visual examination of mine seals while riding into the mine on a hoisted slope entry conveyance (gunboat) in the mine’s main intake aircourse combined with air quality and quantity measurements where air enters the slope and where it splits at the gangway(s).

On August 31, 2007, the petitioner requested that the petition for modification Docket No. M-2007-030-C be withdrawn because the mine had no working sections and a modification was not needed. On February 4, 2008, the petitioner’s request to withdraw the modification was forwarded to MSHA’s Arlington offices.
